2026 midterms: What congressional control can change

- November 3, 2026

The November 3 midterm elections will determine who controls the House and Senate, with consequences for legislation, congressional investigations and presidential appointments. But winning Congress does not give either party complete control of the federal government.

The Federal Election Commission lists Tuesday, November 3, as the regularly scheduled federal general election. All 435 House seats are contested every two years, while Senate elections are staggered because senators serve six-year terms, according to USAGov.

What changes in the House

Representatives serve two-year terms and participate in writing legislation, offering amendments and committee work. The House’s official guide explains that committees also oversee federal agencies, programs and activities.

That makes committee leadership an important part of the election’s consequences. The balance of seats shapes the distribution of committee assignments and the people leading legislative and oversight work. Control of the chamber matters beyond the final votes taken on the House floor.

Why the Senate matters separately

The Senate reviews presidential nominations to executive and judicial positions. Its constitutional responsibilities also include considering treaties and conducting impeachment trials, while the House has the power to impeach.

Ordinary legislation faces a different procedural hurdle: the Senate’s explanation of cloture describes a three-fifths threshold, normally 60 votes, for ending debate on legislation. A simple majority therefore does not necessarily provide the votes needed to advance a contested bill. Different rules can apply to other business.

A congressional majority has limits

The president retains the veto. As the National Archives explains, legislation passed by both chambers is presented to the president, and overriding a veto requires two-thirds support in each chamber.

The practical result is that election-night seat totals answer only part of the governing question. Readers also need to distinguish the powers of each chamber, the procedural votes required and the president’s role in making legislation law.
